Terms & Conditions
These Terms & Conditions set out the rules for using Flexpass, including the purchase of flexible gym passes, access to partner gyms and fitness studios across the UK, and use of our website and app. Please read carefully before completing your membership.
These Terms and Conditions (“Terms”) govern all purchases and use of services provided by Sweat House Ltd (16587977), trading as Flexpass (“we”, “us”, “our”).
1. Contract Formation
1.1 A contract is formed when you complete payment and Flexpass issues confirmation of the service purchased.
1.2 Flexpass provides only access credentials (Passes) enabling you to enter Partner Venues. We do not provide fitness facilities or instruction.
1.3 By purchasing or using our services, you agree to be bound by these Terms and the Health Agreement, which forms part of these Terms.
2. Use of Services
2.1 Passes are strictly personal, non-transferable, and may not be shared, resold, or assigned.
2.2 Partner Venues may require you to present valid photo identification before granting entry.
2.3 You must comply with all rules, policies, and instructions of Partner Venues. Failure to do so may result in refusal of entry without refund.
2.4 Flexpass is not responsible for changes to Partner Venue facilities, opening hours, class availability, or access rules.
3. Types of Services
Flexpass currently offers the following digital membership Pass options:
1 Day Pass – Valid for one entry and expires at midnight on the calendar day of purchase.
3 Day Pass – Valid for multiple entries and expires at midnight on the second consecutive calendar day after the date of purchase.
7 Day Pass – Valid for multiple entries and expires at midnight on the sixth consecutive calendar day after the date of purchase.
30 Day Pass – Valid for multiple entries and expires at midnight on the twenty-ninth consecutive calendar day after the date of purchase.
All Passes expire strictly at midnight (UK time) on the final valid day and do not roll over into the following day.
All Passes are activated immediately at the time of purchase. Once expired at midnight (UK time) on the final valid day, Passes cannot be reinstated, extended, or refunded under any circumstances.
4. Refunds and Cancellations
4.1 All digital memberships (Passes) are strictly non-refundable once purchased, except where required by law.
4.2 Expired services cannot be refunded, credited, or extended.
4.3 If a Partner Venue closes permanently before your service is redeemed, Flexpass may, at its sole discretion, provide a refund or alternative service.
4.4 If a Partner Venue refuses entry for reasons beyond your control, you must contact Flexpass immediately. Flexpass may, at its discretion, offer a refund or replacement, but is under no obligation to do so.
4.5 Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or any applicable consumer protection legislation. While digital memberships (Passes) are non-refundable, you remain entitled to remedies if our Services are misrepresented or not provided with reasonable care and skill.
5. Liability and Risk
5.1 You acknowledge that exercise involves risks of injury and health complications, and you accept these risks voluntarily. 5.2 Flexpass:
Excludes all liability for injury, illness, accident, or death arising from the use of Partner Venues.
Excludes all liability for acts, omissions, negligence, or default of Partner Venues.
Provides no guarantee of the safety, suitability, or quality of Partner Venues.
5.3 To the extent liability cannot be excluded by law, Flexpass’s total liability is limited to the price paid for the specific service concerned.
5.4 You agree to indemnify Flexpass against any claims or proceedings brought by Partner Venues, third parties, or other users as a result of your actions or omissions.
6. Age Restrictions
You must be at least 16 years old to purchase or use our Services. If you are under 18, you may only use our Services with the consent and supervision of a parent or legal guardian, who agrees to be responsible for your compliance with these Terms. Flexpass does not knowingly enter into contracts with minors without such consent.
7. Personal Information
All personal data is handled in accordance with our Privacy Policy.
8. Force Majeure
Flexpass is not liable for any failure or delay caused by events outside its reasonable control, including but not limited to strikes, government restrictions, pandemics, venue closures, or IT failures.
9. Termination
Flexpass may suspend or terminate your access if:
You breach these Terms or the Health Agreement.
You misuse services or attempt fraud.
You engage in abusive, illegal, or antisocial conduct at Partner Venues.
10. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. You may bring legal proceedings in the courts of England and Wales, or in Scotland/Northern Ireland if you reside there.
Before commencing legal proceedings, you agree to attempt to resolve any dispute with Flexpass by good faith negotiation, and, if unresolved, through mediation or arbitration in London, United Kingdom. Legal proceedings may only be initiated if such attempts fail. This does not affect your statutory rights.
11. Entire Agreement
These Terms, together with the Health Agreement, Cookie Policy and Privacy Policy, constitute the entire agreement between you and Flexpass.
