Terms & Conditions
These Terms & Conditions set out the rules for using Flexpass, including the purchase of flexible gym passes, access to partner gyms and fitness studios across the UK, and use of our website and app. Please read carefully before completing your membership.
These Terms and Conditions (“Terms”) govern all purchases and use of services provided by Sweat House Ltd (16587977), trading as Flexpass (“we”, “us”, “our”).
1. Contract Formation
1.1 A contract is formed when you complete payment and we issue confirmation of your purchase.
1.2 We provide access to fitness and wellness facilities operated by our Partner Venues through our digital membership plans (“Plans”). We do not own, manage, or operate these facilities.
1.3 By purchasing or using our services, you agree to be bound by these Terms and the Health Agreement, which form part of this Agreement.
2. Use of Services
2.1 Membership plans are strictly personal, non-transferable, and may not be shared, resold, or assigned
2.2 Partner Venues may require you to present valid photo identification before granting entry.
2.3 You must comply with all rules, policies, and instructions of Partner Venues. Failure to do so may result in refusal of entry without refund.
2.4 We are not responsible for changes to Partner Venue facilities, opening hours, class availability, or access rules.
3. Types of Services
We currently offer the following membership plans (“Plans”):
Basic Plan – Includes 5 credits that are valid for 30 days from the date of purchase. This plan is non-recurring and must be manually renewed if you wish to access all fitness clubs.
Standard Plan – Includes 30 credits that renew automatically every month on your billing date, provided your membership remains active.
Silver Plan – Includes 60 credits that renew automatically every month on your billing date, provided your membership remains active.
Gold Plan – Includes 90 credits that renew automatically every month on your billing date, provided your membership remains active.
Platinum Plan – Includes 180 credits that renew automatically every month on your billing date, provided your membership remains active.
All credits are valid for 30 days from the date of issue and automatically expire at midnight on the thirtieth day. Credits do not roll over, accumulate, or extend beyond their validity period.
All membership plans automatically expire at the end of their validity period. Once expired, memberships and credits cannot be reinstated, extended, or refunded under any circumstances.
Plans and prices displayed reflect standard pricing but are subject to change at any point without prior notice.
4. Minimum Term
Where we offer a promotion or discounted pricing tied to a fixed term, the membership plan may have a minimum term specified at checkout.
If a minimum term applies, you may not pause or cancel your plan until you are within the final billing period of the minimum term.
At the end of the minimum term, the plan will renew at the full price unless you cancel in accordance with these Terms.
5. Pause / Temporary Suspension
Provided any minimum term has been fulfilled (if applicable), you may request to pause your membership plan for a temporary period.
While your plan is paused, you will not have access to Partner Venues and billing will be suspended until your plan resumes.
If you do not resume within the specified period (as notified when pausing), your plan may resume automatically or you may lose the ability to resume on previous terms.
6. Refunds and Cancellations
6.1 All membership plans and credits are strictly non-refundable once purchased, except where required by law.
6.2 Expired plans or unused credits cannot be refunded, credited, or extended.
6.3 If a Partner Venue closes permanently before your plan or credits are redeemed, we may, at our sole discretion, provide a refund or alternative service.
6.4 If a Partner Venue refuses entry for reasons beyond your control, you must contact us immediately. We may, at our discretion, offer a refund or replacement but are under no obligation to do so.
6.5 If a refund is issued, it will be entirely at our discretion.
6.6 Payments must be made using a card or account registered in the passholder’s name. If payment is made using details that do not belong to the passholder, we reserve the right to cancel the membership immediately without refund.
6.7 Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or applicable consumer protection laws.
7. Promotions, Vouchers and Discount Codes
From time to time, we may offer vouchers, discount codes or promotional offers.
Unless explicitly stated:
(a) vouchers and codes apply only to purchases made via our website or app;
(b) vouchers and codes cannot be combined with other offers;
(c) vouchers and codes have no cash value and are non-transferable;
(d) we reserve the right to withdraw or amend any promotion, voucher, or discount code at any time without notice;
(e) promotions are valid only during their published validity period.
8. Liability and Risk
8.1 You acknowledge that exercise involves risks of injury and health complications, and you accept these risks voluntarily.
8.2 We exclude all liability for:
Injury, illness, accident, or death arising from the use of Partner Venues.
Acts, omissions, or negligence of Partner Venues.
Any representation as to the safety, suitability, or quality of Partner Venues.
8.3 To the extent liability cannot be excluded by law, our total liability is limited to the amount paid for the specific membership plan concerned.
8.4 You agree to indemnify us against any claims or proceedings brought by Partner Venues, third parties, or other users as a result of your actions or omissions.
9. Age Restrictions
You must be at least 16 years old to purchase or use our services. If you are under 18, you may only use our services with the consent and supervision of a parent or legal guardian, who agrees to be responsible for your compliance with these Terms.
10. Personal Information
All personal data is handled in accordance with our Privacy Policy, which forms part of these Terms.
11. Assignment / Transfer
Neither party may assign or transfer any of its rights or obligations under these Terms without the prior written consent of the other, except where Flexpass assigns its rights as part of a merger, acquisition, or sale of the business. Any assignment without such consent will be void.
12. Force Majeure
We are not liable for any failure or delay caused by events beyond our reasonable control, including but not limited to strikes, government restrictions, pandemics, venue closures, or IT failures.
13. Termination
We may suspend or terminate your access if:
You breach these Terms or the Health Agreement.
You misuse services or attempt fraud.
You engage in abusive, illegal, or antisocial conduct at Partner Venues.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales.
You may bring legal proceedings in the courts of England and Wales, or in Scotland/Northern Ireland if you reside there.
Before commencing legal proceedings, you agree to attempt to resolve any dispute with us by good faith negotiation and, if unresolved, through mediation or arbitration in London, United Kingdom.
This does not affect your statutory rights.
15. Entire Agreement
These Terms, together with the Health Agreement, Privacy Policy, and Cookie Policy, constitute the entire agreement between you and Sweat House Ltd trading as Flexpass.
