Health Agreement

This Health Agreement (“Agreement”) applies to all purchases and uses of services provided by Sweat House Ltd (Company No. 16587977), trading as Flexpass (“we”, “us”, “our”), including but not limited to the purchase of digital memberships (“Passes”) via flexpass.co.uk.

1. Your Health and Acknowledgements

1.1 You acknowledge and agree that participation in physical exercise, fitness activities, or the use of gym equipment carries inherent risks of injury, illness, accident, or death.


1.2 You warrant, represent, and confirm that:

• You are in good physical condition and not knowingly incapable of engaging in exercise.

• You have disclosed any medical condition which may make exercise unsafe.

• You have sought medical advice where appropriate, and your GP or medical professional has confirmed it is safe for you to exercise.

• You are not pregnant, recently postnatal, or breastfeeding unless a qualified medical professional has confirmed in writing that you may safely exercise.

1.3 You accept sole responsibility for monitoring your health, medical condition, and ability to participate in exercise at all times.


1.4 If at any time you feel pain, dizziness, shortness of breath, or discomfort, you must immediately stop exercising and seek medical attention.

2. Our Role

2.1 Flexpass is a booking and access service. We do not own, manage, or operate any Partner Venue.


2.2 Flexpass does not supervise exercise, provide instruction, or guarantee the safety of equipment, facilities, or staff at Partner Venues.


2.3 All health and safety responsibilities rest with the Partner Venue.

3. Exclusion of Liability

3.1 Flexpass does not accept responsibility or liability for:

• Injury, illness, accident, or death arising from the use of Partner Venues.

• Any negligent act, omission, or breach of duty by Partner Venues, their staff, or contractors.

• Any defects, faults, or hazards in the facilities, premises, or equipment of Partner Venues.

• Any third-party digital services, workouts, or recommendations accessed via Flexpass.

3.2 To the fullest extent permitted by law, Flexpass excludes liability for any indirect, consequential, or incidental losses, including loss of income, business, opportunity, or enjoyment.

3.3 Where liability cannot be excluded by law, Flexpass’s total liability is strictly limited to the price paid for the specific service giving rise to the claim.

3.4 Partner Venues are independent businesses and are not owned, managed, or controlled by Flexpass. They are not agents, employees, or representatives of Flexpass. Flexpass does not warrant or guarantee the quality, safety, suitability, or compliance with law of any Partner Venue, its staff, equipment, or facilities.

4. Indemnity

You agree to fully indemnify and hold harmless Flexpass, its directors, employees, contractors, and affiliates against any claims, costs, demands, losses, or liabilities brought by Partner Venues, third parties, or other users arising from your use of our services, your conduct at a Partner Venue, or your breach of this Agreement.

5. Confirmation

By purchasing or using our services, you confirm that you have read, understood, and accepted this Health Agreement, and that you enter into it voluntarily and entirely at your own risk. You also acknowledge that all digital memberships (Passes) are valid from the date and time of purchase, expire strictly at midnight (UK time) on the final valid day of the duration purchased (1, 3, 7 or 30 days), and do not roll over into the following day.
